Hai Yang, President of Steele,became the member of Global Association of Risk Professionals (GARP) on September 15, 2005, which is one of the biggest finance associations in the world. Its aim is to encourage and enhance communications between risk professionals, practitioners and regulators worldwide, and to improve the professional quality of its members. Through its events, publications, website and certification examination, GARP works on expanding views and increasing recognition of the global risk management community.

Steele was invited to attend the “China-Florida Business Seminar” on October 24, 2005. In the seminar held by China Council of Promotion of International Trade (CCPIT), Steele’s consultants exchanged ideas of enterprise risk control with the businessmen from China and America .

The application and approval procedure of “Steele Scholarship” (for 2005-2006 academic year) has started since October 10 in Law School of Peking University.

The People’s Court of Chaoang District has opened the first Execution Hotline (85998855) of courts in Beijing . There is a person specially assigned for answering questions at working hours and a Party Mail Box was set up at the exit of the Hall, where the cases were filed. The juge in charge of judgement execution deals with the mails in the Party Mail Box every day. In addition, a presiding judge would be appointed to check the email box of the executive presiding judge daily (cyzxt@sina.com ) and answers the emails if necessary.

The system of out-of-court settlement of the civil case has been applied to a criminal case for the first time by the People’s Court of Chaoyang District. In a civil suit collateral to criminal proceedings, if the criminal suspect’s family actively requests reconciliation, the criminal may be given a lesser punishment at judge’s discretion. This system is mainly applied to criminal case of private prosecution and civil suit collateral to criminal proceedings, such as the case about slight injury, abuse, bigamy, and etc.

The Intermediate People’s Court of Haerbin had announced the names of 304 persons on the Internet, for they defaulted the effective judgments made by the court for a long time. China Insurance Regulatory Commission (CIRC) publicized the list of 2nd Quarter 2005 Administrative Punishment for Insurance Agency. There were 16 insurance agencies having received 24 times administrative punishments in total. For details please refer to http://www.circ.gov.cn/news/b.xls.

Common Knowledge of Law    What Is The More Convincing Evidence?

 

If there is evidence in different forms, to choose the more convincing evidence is a big problem. Generally speaking, the following situations shall be taken into consideration.sssssssssssss

1) Material evidence, archives or public records, expert conclusions, records of inspection, and notarised or registered documentary evidence are more convincing than audio-visual material, testimony of witnesses, and other documentary evidence. 2) The testimony of witnesses from other persons is more convincing than the favourable evidence provided by the party’s relatives or other person who has close relationship with the party. 3) Original evidence is more convincing than duplication.  4) It is approved that one party has evidence but refuses to provide it without reasonable excuse. Under such a circumstance, if the opposite party asserts that the evidence is against the evidence holder, the assertion will be accepted. 5) If one party recognizes the evidence provided by the other party, the evidence will be effective evidence. 6) If one party cannot disprove the evidence provided by the other party, the evidence may be regarded as effective evidence according to other details of the whole case.
